data-start=\"401\" data-end=\"463\">Article 88 of the LOPDGDD states:<\/p>\n<blockquote data-start=\"465\" data-end=\"651\">\n<p data-start=\"467\" data-end=\"651\">\u201cEmployees and public workers shall have the right to digital disconnection outside of working hours under the terms set out in collective bargaining agreements or company agreements.\u201d<\/p>\n<\/blockquote>\n<p data-start=\"653\" data-end=\"790\">Additionally, in cases of remote work, Law 10\/2021 requires that digital disconnection be regulated in individual teleworking agreements.<\/p>\n<h3 data-start=\"792\" data-end=\"892\"><span class=\"ez-toc-section\" id=\"Is_a_written_protocol_mandatory\"><\/span><strong data-start=\"792\" data-end=\"828\">Is a written protocol mandatory?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"792\" data-end=\"892\">It depends on the type of company and its internal structure.<\/p>\n<p data-start=\"894\" data-end=\"927\">A formal protocol is mandatory:<\/p>\n<ul data-start=\"928\" data-end=\"1138\">\n<li data-start=\"928\" data-end=\"1015\">\n<p data-start=\"930\" data-end=\"1015\">If the company has legal representation of employees (committees, union delegates).<\/p>\n<\/li>\n<li data-start=\"1016\" data-end=\"1071\">\n<p data-start=\"1018\" data-end=\"1071\">If the applicable collective agreement requires it.<\/p>\n<\/li>\n<li data-start=\"1072\" data-end=\"1138\">\n<p data-start=\"1074\" data-end=\"1138\">If remote work is implemented in the organization (Law 10\/2021).<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1140\" data-end=\"1186\">It is not mandatory, but highly recommended:<\/p>\n<ul data-start=\"1187\" data-end=\"1386\">\n<li data-start=\"1187\" data-end=\"1262\">\n<p data-start=\"1189\" data-end=\"1262\">In SMEs without legal representation or a binding collective agreement.<\/p>\n<\/li>\n<li data-start=\"1263\" data-end=\"1386\">\n<p data-start=\"1265\" data-end=\"1386\">In companies without remote work or specific legal requirements.<br data-start=\"1329\" data-end=\"1332\" \/>In all cases, the right must be respected and
