However, this right is not absolute or unilateral. Employers have the right to assess the request based on the <strong data-start=\"1345\" data-end=\"1379\">principle of co-responsibility<\/strong>.<\/p>\n<h3 data-start=\"1382\" data-end=\"1436\"><span class=\"ez-toc-section\" id=\"What_does_the_principle_of_co-responsibility_mean\"><\/span><strong>What does the principle of co-responsibility mean?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"1438\" data-end=\"1740\">The <strong data-start=\"1442\" data-end=\"1476\">Organic Law 3\/2007 on Equality<\/strong> established the principle of co-responsibility, which means that caregiving duties should be shared between both parents whenever possible. It\u2019s not only about recognizing the employee&#8217;s right to request a schedule adjustment companies also have the right to ask:<\/p>\n<ul data-start=\"1742\" data-end=\"1891\">\n<li data-start=\"1742\" data-end=\"1792\">\n<p data-start=\"1744\" data-end=\"1792\">Can caregiving be shared between both parents?<\/p>\n<\/li>\n<li data-start=\"1793\" data-end=\"1840\">\n<p data-start=\"1795\" data-end=\"1840\">Is the requested time slot truly essential?<\/p>\n<\/li>\n<li data-start=\"1841\" data-end=\"1891\">\n<p data-start=\"1843\" data-end=\"1891\">Are there other viable organizational solutions?<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"1893\" data-end=\"2088\">This principle allows companies to request <strong data-start=\"1936\" data-end=\"1975\">reasonable supporting documentation <\/strong>such as the working hours of the other parent or child custody agreements in case of separation before deciding.<\/p>\n<h3 data-start=\"2090\" data-end=\"2146\"><span class=\"ez-toc-section\" id=\"When_is_it_legal_to_deny_a_work_schedule_adjustment\"><\/span><strong>When is it legal to deny a work schedule adjustment?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"2148\" data-end=\"2493\">One relevant example is a recent case ruled by the <strong data-start=\"2199\" data-end=\"2276\">High Court of Justice of the Canary Islands (STSJ ICAN 1731\/2024, June 6)<\/strong>. An employee requested a fixed schedule from 9:00 to 14:00 to care for her child. However, her partner, who worked in the same store, already had a fixed morning shift (6:00 to 14:00), making afternoon care possible.<\/p>\n<p data-start=\"2495\" data-end=\"2652\">The company <strong data-start=\"2507\" data-end=\"2529\">denied the request<\/strong> for organizational reasons and because <strong data-start=\"2569\" data-end=\"2597\">shared care was feasible<\/strong>. The court upheld the company&#8217;s decision, ruling that:<\/p>\n<ul data-start=\"2654\" data-end=\"2880\">\n<li data-start=\"2654\" data-end=\"2762\">\n<p data-start=\"2656\" data-end=\"2762\">A significant organizational effort is not required when co-responsibility within the family is possible<\/p>\n<\/li>\n<li data-start=\"2763\" data-end=\"2826\">\n<p data-start=\"2765\" data-end=\"2826\">The request was <strong data-start=\"2781\" data-end=\"2824\">not proportionate or strictly necessary<\/strong><\/p>\n<\/li>\n<li data-start=\"2827\" data-end=\"2880\">\n<p data-start=\"2829\" data-end=\"2880\">The company had offered <strong data-start=\"2853\" data-end=\"2880\">reasonable alternatives<\/strong><\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2882\" data-end=\"2921\"><span class=\"ez-toc-section\" id=\"Best_practices_for_employers_and_HR\"><\/span><strong>Best practices for employers and HR<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"2923\" data-end=\"2981\">To ensure fairness and legal compliance, companies should:<\/p>\n<p data-start=\"2983\" data-end=\"3199\">\u2705 Evaluate each request individually<br data-start=\"3019\" data-end=\"3022\" \/>\u2705 Ask for relevant and proportionate documentation<br data-start=\"3072\" data-end=\"3075\" \/>\u2705 Propose reasonable alternatives if possible<br data-start=\"3120\" data-end=\"3123\" \/>\u2705 Respect the right to care but <strong data-start=\"3155\" data-end=\"3199\">balance it with the organization\u2019s needs<\/strong><\/p>\n<p data-start=\"3201\" data-end=\"3481\">Most importantly, the employee must act in <strong data-start=\"3244\" data-end=\"3258\">good faith<\/strong>, providing transparent and accurate information. The goal is not to <strong data-start=\"3327\" data-end=\"3353\">deny the right to care<\/strong>, but to ensure that it is exercised <strong data-start=\"3390\" data-end=\"3405\">responsibly<\/strong> and in line with the real circumstances of both the family and the company.<\/p>\n<h3 data-start=\"3488\" data-end=\"3506\"><span class=\"ez-toc-section\" id=\"Final_thoughts\"><\/span><strong>Final thoughts<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p data-start=\"3508\" data-end=\"3782\">The right to request work schedule adjustments is essential for work-life balance.
