New guide on data processing in the use of biometric systems (time and attendance)

The Spanish Data Protection Agency has published the "GUIDE ON PRESENCE CONTROL TREATMENTS THROUGH BIOMETRIC SYSTEMS".

This new guide sets the criteria for the use of this technology and discusses the processing of data collected through these computer systems.

It is established that the data collected will be considered high-risk, even if it has been collected to carry out the mandatory time and attendance control (for work purposes).

Among others, it determines that "in the event of intending to collect biometric data, prior to the start of the processing, it will be mandatory to carry out a Data Protection Impact Assessment in which, among other aspects, it will be accredited that the triple analysis of suitability, necessity and proportionality of the processing has been overcome".
