The Spanish Data Protection Agency has published the “GUIDE ON PRESENCE CONTROL TREATMENTS USING BIOMETRIC SYSTEMS”
This new guide establishes the criteria for the use of this technology and discusses the processing of data collected through these computer systems.
It establishes that the data collected will be considered high risk, even if they have been collected to carry out mandatory presence control (for work purposes).
Among others, it determines that “in the event of intending to capture biometric data, prior to the start of the treatment, it will be mandatory to carry out a Data Protection Impact Assessment in which, among other aspects, the passing of the triple analysis of suitability, necessity and proportionality of the treatment is accredited.”
