The LISMI establishes the obligation of companies to hire a minimum number of people with disabilities based on their size and number of employees. The regulation establishes that companies with 50 or more employees must reserve an employment quota for people with disabilities that corresponds to 2% of the total workforce, calculated according to technical criterion 98/2016.
Companies can comply with this obligation in different ways, such as, for example, by directly hiring people with certified disabilities equal to or greater than 33%, subcontracting services to companies whose corporate purpose is the labor integration of people with disabilities, or making donations to foundations and entities dedicated to the labor integration of people with disabilities.
It is important to note that failure to comply with this obligation may lead to economic sanctions for the company.
In addition, companies must, within the first quarter of each year, send to the labor authority of the autonomous community in which they have their registered office or work centers, a detailed list of the jobs occupied by people with disabilities and those that, due to their characteristics, are reserved for them.
Each autonomous community must enable a channel through which companies can communicate this list.
